Schwarzenegger Bans Smoking with Kids in Cars

Not that I smoke in the car when my son is with me (especially with the windows up). This is more about the “man” getting in your business.

News 10 reports:

It will soon be illegal to smoke in cars when children are inside. Gov. Schwarzenegger signed legislation Wednesday banning smoking in vehicles when children are present.

Supporters say the law is needed to help protect young lungs from the dangers of secondhand smoke. Opponents called it a “nanny-government” measure, because they say it intrudes on individual liberties.

Senate Bill 7 by Sen. Jenny Oropeza, D-Long Beach, will prohibit drivers and passengers from smoking cigars, cigarettes and pipes when the car is in motion and at rest.

The bill imposes a $100 fine on smokers who violate the new law. It takes effect January 1, 2008.

    While I appreciate the desire to protect children from second-hand smoke
    exposure in cars, I’m afraid that the suggestion to ban smoking in cars occupied
    by children represents an unwarranted intrusion into the privacy and autonomy
    of parenthood.
    The autonomy to make one’s own decision about what risks to subject a child
    to is not to be interfered with lightly. It should only be done in cases where there
    is a substantial threat of severe harm to the child.
    Interfering with parental autonomy in a case where there is only minor risk involved is unwarranted.
